Colorado DUI-THC Dismissed
On January 22, 2013, our defense partner, Clifton Black, earned another Colorado DUI-THC Dismissal on behalf of one of his clients. Because our client had been fully aware of his Constitutional Rights and retained an experienced attorney, his case was quickly dismissed. Earning a Colorado DUI-THC dismissal can be challenging if you are not aware of your rights.
Know your rights
If the police are questioning you, be aware of your constitutional rights. As attorneys, we always advise clients to become familiar with the Fourth, Fifth, and Sixth Amendments to avoid unnecessary charges or worse. Additionally, always be polite to law enforcement.
Fourth Amendment Rights: You have the right to object to search your person, home, or property. While an officer may have a legal right to search, you are not required to consent.
Fifth Amendment Rights: You have the right to remain silent. Unless you are under the advice of an attorney to talk to the police, politely provide your name and address. Invoke your Fifth Amendment right for all other questions presented by law enforcement.
Sixth Amendment Rights: You have the right to an attorney. If you are being questioned by the police, again, provide your name and address, then immediately request an attorney.
