Colorado Natural Medicine Health Act Allowing Personal Use and Future Commercial Enterprises

Despite the legal restrictions and hazards of using hallucinogenic mushrooms, some states and municipalities have started to decriminalize or legalize psilocybin and other hallucinogens. For example, Denver Colorado, became the first city to decriminalize psilocybin, followed by laws in Oregon and Washington, D.C. for the use of certain psychedelics and other drugs. In 2022, Colorado voters approved Colorado’s Natural Medicine Health Act, allowing the personal possession, use, and cultivation of psilocybin mushrooms for personal use, and other natural medicines. Generally speaking, magic mushrooms are no longer criminal offenses, provided the participant follows the Natural Medicine Health Act and the rules and regulations being developed thereto. However, the sale, distribution for remuneration, and possession with intent to sell are still illegal, and psilocybin remains a Schedule I drug under Federal law. The concern is that some individuals may unintentionally act outside the scope of the law.

The legalization of psilocybin and other hallucinogens in Colorado has sparked a debate about the benefits and risks of psychedelic drugs and their place in society. Supporters of the change in our laws argue that psilocybin and the other Natural Medicines can have therapeutic benefits and that the prohibition of these drugs has caused more harm than good, fueling the black market, violence, and mass incarceration. Opponents of decriminalization argue that psilocybin can be harmful, addictive, and lead to public health and safety issues.

What are Hallucinogenic Mushrooms?

Hallucinogenic mushrooms are a type of fungus that contains psychoactive compounds that can cause hallucinations and alter perceptions, emotions, and thoughts. These mushrooms are also known as magic mushrooms, shrooms, boomers, or psychedelic mushrooms. The active ingredient in these mushrooms is psilocybin and psilocin, compounds that are chemically similar to serotonin, a neurotransmitter that affects mood, appetite, and sleep. Psilocybin is a Schedule I drug under the United States Controlled Substances Act, meaning that it has a high potential for abuse, no accepted medical use, and a lack of safety for use even under medical supervision and, therefore, remains illegal under Federal law.

Where do Hallucinogenic Mushrooms Come From?

Hallucinogenic mushrooms have been used for thousands of years by indigenous people in different parts of the world for their spiritual, religious, and healing properties. The mushrooms grow naturally in many regions, particularly in subtropical and tropical climates, on different substrates such as wood chips, straw, manure, and soil. In the wild, the mushrooms can be difficult to identify and differentiate from poisonous mushrooms, which can lead to accidental poisoning and even death. The cultivation and distribution of hallucinogenic mushrooms are illegal in most countries, including the United States, and can result in severe legal consequences.

Advantages and Disadvantages of Using Hallucinogenic Mushrooms

Hallucinogenic mushrooms can induce intense and mystical experiences that can be insightful, transformative, and therapeutic for some individuals. The effects of psilocybin can include altered perception of time and space, heightened emotions, and spiritual experiences. Some research has suggested that psilocybin may have therapeutic potential for treating depression, anxiety, PTSD, addiction, and end-of-life distress, although more research is needed to confirm these effects.

On the other hand, hallucinogenic mushrooms can also have adverse effects that can be unpredictable and dangerous. The use of psilocybin can cause nausea, vomiting, anxiety, panic attacks, paranoia, and psychosis, particularly in high doses or susceptible individuals. The effects of psilocybin can last for several hours, and users can experience flashbacks or persisting perceptual disturbances after the use of the drug. Hallucinogenic mushrooms can lead to social, occupational, and legal problems. Individuals considering experimenting with magic mushrooms or other hallucinogens should do so with supervision from a person qualified and experienced.
