Attorney Clifton Black receives dismissal for a client charged with a traffic infraction and Impersonation of a Police Officer, a class 6 felony punishable by up to 18 months in prison.

The client was contacted by the police, who believed that the client was violating a traffic offense. During the investigation, law enforcement believed they had evidence indicating that the client was impersonating a police officer.

Mr. Black researched Colorado’s laws, including the Colorado Department of Motor Vehicle’s rules and regulations. Mr. Black prepared a memo to the prosecutor laying out the law related to the alleged traffic violation, showing that the activity that the client was involved in was lawful activity. Mr. Black was also able to show the prosecutor that the client did not take any steps to act as a law enforcement officer.

Colorado law, C.R.S. 18-8-112 Impersonating a Police Officer provides, in part, a person impersonates a police officer if that person falsely pretends to be a police officer and performs an additional act while pretending in that role.

After reviewing the evidence, witness reports, and body cam, Mr. Black gathered information showing that the law enforcement officer did not understand the law and used conjecture to trump up charges.
